4. Acceptable Use

You agree not to:

Violate intellectual property rights
Transmit malware or harmful content
Disrupt or interfere with security features
Use the Services for unlawful or abusive purposes

5. Payment and Fees

Use of certain Services requires a subscription. Pricing, billing frequency, and payment methods are defined in your agreement or checkout page. All fees are non-refundable unless explicitly stated. CMS reserves the right to adjust pricing upon renewal with notice.

6. Termination

Either party may terminate these Terms with written notice. CMS may suspend or terminate your access to the Services if you breach these Terms, fail to pay, or engage in conduct harmful to our operations or reputation.

7. Intellectual Property

12. Limitation of Liability

To the maximum extent permitted by law, CMS shall not be liable for indirect, incidental, or consequential damages. Our total liability under these Terms shall not exceed $50 or the amount paid by you in the preceding 6 months, whichever is greater.

You agree to indemnify and hold CMS harmless from any claims, damages, liabilities, or expenses arising out of your use of the Services or breach of these Terms.

14. Arbitration and Jury Waiver

You and CMS agree that any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Palm Beach County, Florida. Each party shall bear its own costs and attorneys’ fees. You and CMS also waive any right to a jury trial in any legal proceeding.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida. Any disputes not resolved via arbitration must be litigated in the state or federal courts located in Palm Beach County, Florida.

16. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or website updates. Continued use of the Services after such notice constitutes your acceptance.
